Do I Need to Register My Foreign Divorce in Canada?

Foreign divorce documents being reviewed for recognition in Ontario

Last updated: October 16, 2026

No, you generally do not need to register a foreign divorce in Canada simply because you moved here. Canada does not have a general registration process for foreign divorces.

However, your divorce must be legally recognized in Canada when your marital status matters. And if you're planning to remarry in Ontario, there's a separate process you may need to complete.

Here's what you should know.

Is my foreign divorce automatically recognized in Canada?

A divorce granted outside Canada can be recognized here, but that depends on whether it meets Canadian legal requirements.

Under section 22 of Canada's Divorce Act, one important rule is that either former spouse must have been habitually resident in the country or relevant subdivision where the divorce was granted for at least one year immediately before the divorce proceedings began.

Other recognition rules may also apply, even if neither spouse meets that one-year requirement.

For example, if you obtained a divorce in Turkey before moving to Canada, you generally don't need to register it again just because you now live in Ontario. But whether Canada recognizes that divorce depends on the circumstances.

What if I want to remarry in Ontario?

This is where the rules are different.

If your previous marriage ended in a divorce outside Canada, Ontario generally requires you to obtain a Foreign Divorce Authorization before a marriage licence can be issued.

This is not the same as registering your divorce.

Under section 8(3) of Ontario's Marriage Act, written authorization is required before a marriage licence can be issued to someone whose previous marriage was dissolved or annulled outside Canada, subject to the Act's exceptions.

To apply, Ontario currently requires:

  1. A completed and signed marriage licence application.
  2. A Statement of Sole Responsibility for each foreign divorce.
  3. A legal opinion letter from an Ontario lawyer explaining why the divorce should be recognized.
  4. A copy of the foreign divorce decree or annulment document, with the required translation if it is not in English or French.

Ontario advises that processing may take up to four weeks.

You can find the requirements on Ontario's official marriage information page.

What's the difference between registration, recognition and authorization?

These terms are easy to confuse, but they mean different things.

Registration

Recording a divorce with a government authority. Canada does not generally require foreign divorces to be registered simply because someone moves here.

Recognition

Whether Canadian law treats your foreign divorce as legally effective.

Foreign Divorce Authorization

Written authorization required under Ontario's marriage-licence process when a previous marriage ended outside Canada, subject to applicable exceptions.

An Ontario Foreign Divorce Authorization does not create your divorce. It allows you to proceed with the marriage-licence process when the applicable requirements are met.

Do I need a Canadian divorce certificate?

Not if you already have a foreign divorce that is legally recognized in Canada.

A Canadian divorce certificate is issued in connection with a divorce granted through a Canadian court. You don't normally obtain a Canadian divorce certificate simply by presenting a foreign divorce decree.

Keep your foreign divorce documents somewhere safe. You may need them when applying for a marriage licence, updating certain records or proving your marital status.

If an organization asks for proof of divorce, check exactly what it requires. Some situations may call for a legal opinion or additional supporting documents.

What if Canada doesn't recognize my foreign divorce?

If your divorce does not meet the applicable recognition rules, you may still be treated as married under Canadian law.

That can affect your ability to remarry and may raise other legal issues.

It does not automatically mean you must get divorced again in Canada. A lawyer should first assess whether the existing foreign divorce can be recognized under another legal rule.

For example, even if neither former spouse lived in the country of divorce for one year, there may be another basis for recognition.

Frequently Asked Questions

Do I need to register my Turkish, Pakistani or Indian divorce in Ontario?

There is generally no separate Ontario registration requirement simply because your divorce was granted in one of these countries. Recognition depends on the legal circumstances, not just the country. If you plan to remarry in Ontario, Foreign Divorce Authorization requirements generally apply.

Can I use my foreign divorce certificate in Canada?

You may be able to use it as evidence of your divorce. Whether it is sufficient depends on the purpose and whether the divorce is legally recognized.

Do I need a foreign divorce opinion letter if I'm not remarrying?

Not automatically. An opinion letter may be useful where your marital status needs to be established, but Ontario's specific opinion-letter requirement is part of the Foreign Divorce Authorization process for marriage licences.
